Now I see, they want to remove the chairmen and make the chairman of the education committee of UNO. But according to the judgment of the Appellate Division, the upazila and district chairmen are supposed to write the ACR of UNO and DC. Because, Article 59 of the Constitution says that each district will have three subjects of ‘local governance’. (a) Functions of administration and public servants, (b) Maintenance of public order, (c) Formulation and implementation of public works and economic development plans. He said that DCs do not have the right to withdraw 90% of the proposals presented every year.
They were also opposed to the separation of the judiciary during the framing of the constitution of Pakistan in 1956 and the constitution of independent Bangladesh in 1972. They cannot accept the verdict of Masdar Hossain case in 2007. The mobile court, which was declared illegal by the High Court, is also hanging.
Hidayet-ul-Islam, Member of Constituent Assembly, said, ‘Since the British period and later Pakistan, we have seen that a regime was established by the ruling class…to rule the people. And in that regime we have seen various ICS, BCS…all these officers have always run steamroller on people….they have enjoyed houses, cars and many things with people’s money.
But in fact they have never tried to establish a fair governance system for the betterment of the people…. That is why today the members of the Constituent Assembly think that if the burden of administration is in the hands of the elected representatives and if the administration can be done through them, then the interests of the people will be protected. The purpose will be accomplished and it will be evident that the people are the owners of this country.’
